Supreme Court: सुप्रीम कोर्ट ने आज एक महत्वपूर्ण फैसला सुनाते हुए कहा कि औद्योगिक अल्कोहल पर कानून बनाने का राज्यों का अधिकार छीना नहीं जा सकता। देश की शीर्ष अदालत ने यह निर्णय 8:1 के बहुमत से दिया है। सुप्रीम कोर्ट की 9-सदस्यीय संविधान पीठ ने बहुमत से यह फैसला सुनाया कि राज्यों को औद्योगिक अल्कोहल को नियंत्रित करने का अधिकार है।
1990 का फैसला पलटा
सुप्रीम कोर्ट की 9-सदस्यीय संविधान पीठ ने 1990 के सुप्रीम कोर्ट के फैसले को पलट दिया। पीठ के 8 जजों ने अपने बहुमत के फैसले में कहा कि भले ही औद्योगिक अल्कोहल नशा करने के लिए उत्पादित नहीं किया जाता हो, लेकिन इस प्रकार के सभी पदार्थ नशीले पदार्थों की श्रेणी में आते हैं। राज्य सरकारें इसे नियंत्रित कर सकती हैं और इस पर कर भी लगा सकती हैं। वहीं, न्यायमूर्ति बी.वी. नागरत्ना ने बहुमत से भिन्न निर्णय देते हुए कहा कि केवल केंद्र (संसद) ही इसे नियंत्रित कर सकती है।
1990 में 7-सदस्यीय संविधान पीठ ने Synthetics and Chemicals Ltd vs Uttar Pradesh मामले में कहा था कि “मादक शराब” केवल उसी अल्कोहल को माना जाता है जो नशा करने के उद्देश्य से इस्तेमाल होता है और औद्योगिक अल्कोहल (रेक्टिफाइड या डिनैचर्ड स्पिरिट) को नियंत्रित करना राज्य सरकार के अधिकार क्षेत्र के बाहर है।
राज्य का अधिकार नहीं छीना जा सकता
सुप्रीम कोर्ट ने आज स्पष्ट किया कि औद्योगिक अल्कोहल पर राज्य सरकार को कानून बनाने का अधिकार है और यह अधिकार उनसे छीना नहीं जा सकता। राज्यों के पास औद्योगिक अल्कोहल को नियंत्रित करने का अधिकार है। 9-सदस्यीय पीठ में शामिल न्यायमूर्ति बी.वी. नागरत्ना ने बहुमत से अलग राय रखते हुए कहा कि केंद्र के पास औद्योगिक अल्कोहल को नियंत्रित करने का अधिकार नहीं है। दरअसल, औद्योगिक अल्कोहल मानव उपयोग के लिए नहीं होता है। यह अल्कोहल केवल औद्योगिक गतिविधियों के लिए इस्तेमाल होता है।
यह बताना महत्वपूर्ण है कि संविधान की सातवीं अनुसूची की राज्य सूची के आठवें प्रविष्टि के तहत राज्यों को ‘मादक शराब’ के उत्पादन, कब्जे, परिवहन, खरीद और बिक्री पर कानून बनाने का अधिकार दिया गया है। वहीं, केंद्र सूची की प्रविष्टि 52 और समवर्ती सूची की प्रविष्टि 33 में उन उद्योगों का उल्लेख है जिनका नियंत्रण संसद के कानून द्वारा “लोकहित में उपयुक्त” घोषित किया गया है।
समवर्ती सूची में कानून बनाने का अधिकार
संविधान के प्रावधानों के अनुसार, संसद और राज्य विधानसभाएं समवर्ती सूची में उल्लिखित विषयों पर कानून बना सकती हैं, लेकिन अगर किसी एक ही विषय पर केंद्रीय कानून आता है, तो उसे राज्य कानून पर प्राथमिकता दी जाएगी। 1997 में एक सात-सदस्यीय संविधान पीठ ने इस मुद्दे पर राज्यों के खिलाफ फैसला सुनाया था। इसके बाद, औद्योगिक अल्कोहल के उत्पादन पर केंद्र को नियामक शक्ति होने के मामले को 2010 में नौ-सदस्यीय संविधान पीठ के सामने भेजा गया था।
सुप्रीम कोर्ट का ऐतिहासिक फैसला: बहुमत का निर्णय
सुप्रीम कोर्ट की 9-सदस्यीय संविधान पीठ का फैसला आने के बाद औद्योगिक अल्कोहल को नियंत्रित करने के अधिकार पर राज्यों की जीत मानी जा रही है। आठ न्यायाधीशों ने अपने बहुमत निर्णय में कहा कि औद्योगिक अल्कोहल, भले ही नशे के लिए न बनाया गया हो, एक नशीले पदार्थ की श्रेणी में आता है और इस पर राज्य का नियंत्रण वैध है। उन्होंने कहा कि राज्य सरकारों को इस पर कानून बनाने और इसे नियंत्रित करने का पूरा अधिकार है।
न्यायमूर्ति बी.वी. नागरत्ना, जो इस पीठ में एकमात्र असहमति रखने वाली न्यायाधीश थीं, ने अपने असहमति निर्णय में कहा कि चूंकि औद्योगिक अल्कोहल नशा करने के लिए नहीं होता, इसलिए यह नशीली शराब की श्रेणी में नहीं आता। इस कारण इसे नियंत्रित करने का अधिकार केवल केंद्र सरकार के पास होना चाहिए। हालांकि, बहुमत का निर्णय यह था कि राज्यों को औद्योगिक अल्कोहल पर कर लगाने और इसे नियंत्रित करने का अधिकार है।
राज्यों का तर्क
राज्यों का तर्क था कि उन्हें औद्योगिक अल्कोहल पर कर लगाने और नियंत्रण करने का अधिकार होना चाहिए, क्योंकि इसे नशीली शराब की श्रेणी में माना जा सकता है। इसके अतिरिक्त, वे इस पर कर लगाने से होने वाली आय का उपयोग अपने राज्यों के विकास के लिए कर सकते हैं। यह तर्क भी दिया गया कि औद्योगिक अल्कोहल का विनिर्माण और वितरण राज्य स्तर पर नियंत्रित होना चाहिए, ताकि इसका दुरुपयोग न हो सके।
केंद्र का पक्ष
केंद्र सरकार का पक्ष था कि औद्योगिक अल्कोहल को नशीली शराब की श्रेणी में नहीं माना जा सकता, क्योंकि यह मुख्य रूप से औद्योगिक कार्यों के लिए उत्पादित किया जाता है, न कि मानव उपभोग के लिए। केंद्र ने यह भी तर्क दिया कि औद्योगिक अल्कोहल पर कर लगाने और इसे नियंत्रित करने का अधिकार केवल संसद के पास होना चाहिए, क्योंकि यह राज्य के अधिकार क्षेत्र से बाहर है।
नतीजा
सुप्रीम कोर्ट के इस निर्णय से यह स्पष्ट हो गया है कि राज्यों को औद्योगिक अल्कोहल पर कर लगाने और इसे नियंत्रित करने का अधिकार है। अब राज्यों के पास यह शक्ति होगी कि वे औद्योगिक अल्कोहल के उत्पादन, वितरण और बिक्री पर अपने नियम बना सकें और इससे संबंधित राजस्व वसूल कर सकें।
इस फैसले ने 1990 के सुप्रीम कोर्ट के फैसले को पलट दिया है, जिसने औद्योगिक अल्कोहल को राज्यों के अधिकार क्षेत्र से बाहर माना था। अब राज्यों को इस मुद्दे पर अधिक स्वायत्तता मिल गई है, और वे अपने अनुसार औद्योगिक अल्कोहल के उत्पादन और बिक्री को नियंत्रित कर सकेंगे।
सुप्रीम कोर्ट के इस ऐतिहासिक फैसले से न केवल राज्य सरकारों को उनके अधिकारों का पुनर्स्थापन मिला है, बल्कि इससे औद्योगिक अल्कोहल के उत्पादन और नियंत्रण से संबंधित नीति निर्धारण में भी एक महत्वपूर्ण बदलाव आएगा। राज्य अब इस मुद्दे पर अधिक सशक्त होंगे और इस फैसले का असर न केवल कानून व्यवस्था पर, बल्कि आर्थिक नीति निर्धारण पर भी पड़ेगा।
